Rules and Regulations for using The Elizabeth Bruce Robertson Mayer Art Gallery, hereafter referred to as The Gallery, are outlined in These Terms and Conditions. By accessing this site, exploring the services, and purchasing any artwork, you accept and agree to be bound by these Terms and Conditions.
1. Acceptance of Terms
By visiting The Gallery and purchasing any artwork, you confirm that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with any part of these terms, desist from using the services.
2. Artwork and Pricing:
The Gallery features a curated selection of original pieces. The artwork is produced by various artists, presented in high-quality archival formats, and pricing for each print is standardized, as listed, but is subject to change without prior notice. All sales are considered final.
3. Orders and Payment:
By placing an order, you agree to provide accurate billing information and authorize us to charge the account, in the amount submitted, for the total amount of the purchase, including any applicable taxes and shipping fees. Any purchase will be considered complete once an accepted, valid payment method has been processed and funds recieved.
4. Disclaimer on Color Variability
Please note that the colors on the watercolor prints may vary from what you see on your screen due to differences in display technologies and settings which can affect how colors are represented digitally. Please consider these factors when making your purchase, as the physical print may appear differently than the digital presentation.
5. Shipping and Delivery:
The Gallery strives to process and ship orders swiftly, within five business days from purchase, though shipping may take longer for large orders. Delivery times vary based on location and the shipping method chosen at checkout. We are not responsible for delays caused by shipping carriers or Customs Clearance.
6. Returns and Refunds:
Please refer to the Return Policy for details on eligibility, processes, and conditions regarding returns, refunds, and exchanges. The Gallery encourages you to reach out with any questions regarding your purchase prior to completing your transaction. Note: every order is printed on demand-there is no stock supply-so requesting a size exchange, after the fact, would mean processing an entirely new order.
7. Account Rights:
The Gallery may permanently or temporarily terminate or suspend access to its site/service without notice, and without liability, for any reason, including if, in our sole determination, any provision of these Terms, or any applicable law or regulation, is violated.
8. Copyright and Artwork Reproduction:
All artworks featured in The Gallery are original pieces created by the artists. Reproduction or distribution of any artwork without express written consent from The Gallery is strictly prohibited. All purchases are for personal use only. Commercial usage is possible, and encouraged, but must be negotiated as a custom or bespoke request: please contact The Gallery.
9. Limitation of Liability:
To the maximum extent permitted by applicable law, in no event shall The Gallery and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the website, with the delay or inability to use the website or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the website, or otherwise arising out of the use of the website, whether based on contract, tort, negligence, strict liability or otherwise, even if the Company or any of its suppliers has been advised of the possibility of damages. You further agree to and do hereby waive any right to class arbitration and agree, instead, to conduct an arbitration related solely to any individual claims you and/or any entity related to you asserts against the The Gallery. The Service is controlled, operated and administered by The Gallery from offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use The Gallery accessed through the Website in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
